Lapo Guadalupi
Lapo Guadalupi has extensive knowledge and experience of various aspects of liability as a consequence of exposure to noxious substances (civil, criminal, employment and insurance law implications) in particular in the work environment (asbestos, acids, industrial dust and smoke). He also has significant experience in medical professional indemnity matters, defending medical professionals, patients and hospital bodies.
Lapo has extensive experience in sports law, acting on behalf of professional footballers, agents of individual professional footballers and football clubs, and advocacy in court before state and domestic judges in relation to financial disputes and disciplinary proceedings, including:
- arbitration on financial issues at the Arbitral Tribunal conducted in accordance with the laws provided for under the Agents’ Regulations 2001, relating to failure of payment of agents’ fees and applications for damages;
- disciplinary arbitration proceedings with the arbitral tribunal established by the Lega Calcio (Milan) relating to professional footballers sanctioned by clubs of which they are members;
- numerous arbitrations on financial issues with the arbitral tribunal established by the Lega Pro (Florence) relating to claims for unpaid emoluments, damages and accrued premiums;
- disciplinary proceedings before the Commissione Disciplinare FIGC (FIGC Disciplinary Commission) and the Corte Federale FIGC (FIGC Federal Court); and
- disciplinary proceedings in relation to anti-doping.
His sports law practice also includes drafting and advising in relation to sponsorship contracts, merchandising contracts, and termination of broadcasting rights in relation to sporting events.
Additionally, Lapo has participated in national and international arbitrations, both as arbitrator and lawyer, in accordance with the rules of the principal arbitration institutions (Camera Arbitrale di Milano, AIA) including:
- in accordance with the rules of the Associazione Italiana Arbitrato (Italian Arbitration Association) between Italian companies and under Italian law, in relation to claims stemming from the execution of a contract for the sale of a business;
- between an Italian company and a Brazilian supplier for apparatus to be assembled on an oil rig;
- between Italian companies, under Italian law, relating to the execution of a supply contract for the maintenance of fuel extracting plants; and
- between Italian companies, relating to a supply contract for an oil extraction plant in Russia.
Lapo’s practice also focuses on civil litigation in relation to property law and inheritance issues, and he has significant experience in acting on behalf of liquidators for assistance both in relation to court proceedings (annulment of voluntary conveyances to defraud creditors (opposizioni allo stato)) and in relation to non-court proceedings (distribution of assets).
