Roberto Calabresi
Roberto Calabresi practices commercial litigation, and in particular national and international arbitration, in various countries, and conducted in accordance with the rules of the major institutions, including:
In Italy:
- in accordance with the Rules of the International Chamber of Commerce (ICC), and under Italian law, relating to a contract for the construction and supply of materials for the extension of the national railway line in Albania;
- in accordance with the Rules of the Associazione Italiana Arbitrato (Italian Arbitration Association), between Italian companies and under Italian law, for claims relating to the execution of a contract for the sale of a business;
- between an Italian company and a Brazilian supplier, in relation to apparatus to be assembled on an oil rig;
- between Italian companies, and under Italian law, relating to the execution of a contract for the maintenance of a fuel extracting plant;
- between Italian companies, relating to a supply contract for an oil extracting plant in Russia; and
- between Italian companies, relating to the execution of an agency contract in France.
And abroad:
- in Germany, in accordance with the DIS Rules, between German companies, and under German law, relating to a contract for the sale of a business;
- in India, under English law, between an Italian company and an Indian company, relating to a supply contract for reactors for a refinery;
- in England, in accordance with the Rules of the London Court of International Arbitration (LCIA), and under English law, between an Italian company and a Turkish company, relating to the supply of component parts for an electrical energy production plant; and
- in France, in accordance with the UNCITRAL Rules, under French law, between French companies.
Roberto often uses alternative dispute resolution techniques and settlement of disputes out of court (early dispute resolution, mediation, direct negotiations) and assists the client in identifying the commercial objectives of each issue, including providing a risk assessment in the event of litigation, outlining the most likely scenario of each case (according to the best, most probable and worst case scenario of the outcome of the lawsuit) taking into consideration the cost (both in financial terms and in terms of human resources) and how long resolution of the issue via court action is likely to take.
Roberto has also participated in contractual negotiations and mediation in Italy, England, India, Norway and France. He has represented both Italian and foreign clients in civil litigation proceedings in Italy in relation to inheritance law and property law issues, and has extensive experience in matters of corporate liability relating to the treatment and processing of noxious substances (asbestos, acids, industrial dust and smoke).
